一、什么是「移民倾向」？

加拿大移民法案和条例从来没有「移民倾向」的说法，更多是存在于美国的签证和移民当中。

根据《美国移民和国籍法》第214(b)条规定，所有申请人在申请签证时都会先被假设为有「移民倾向」，除非他 / 她能使签证官相信其具有非移民资格（即临时居民签证）Act Section 214(b) – making you ineligible to receive a non-immigrant visa based on a presumption of being an intending immigrant or not meeting one of the other eligibility requirements for the visa category you applied for.

而《加拿大移民法》第22(2) 条规定，只要签证官相信申请人会按时离开加拿大，未来成为永久居民的意向并不能成为临时居民签证申请拒签的理由 A22(2) An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.


二、「双重意向 Duel Intent」

这涉及到一个官方术语「双重意向 Duel Intent」：同时呈现临时居民和永久居民意向，在加拿大移民法中是合理合法的 Having two intents (one for temporary residence, and one for permanent residence) is legitimate.

因此，虽然签证官不会以「移民倾向」为由而拒签，但如果不相信申请人会按时离开加拿大，拒签将是必然的结果。

三、「访问目的 Purpose of Visit」

申请人有真实清楚的「访问目的Purpose of Visit」且不会逾期逗留，是申请签证最需要注意的地方。

签证官并不担心申请人有所谓的「移民倾向」，而是担心如果签证获批，申请人会将来有非法逾期滞留在加拿大的可能性。

四、「与原籍国的联系 Ties to the home country」

; t% t3 w0 J% l' R% }为了打消签证官的质疑，申请人需要根据自身情况，尽可能提供不会逾期逗留加拿大的证明，体现各方面「与原籍国有很强的联系」。

3 b! o. s! J# M( B# \; ^% I* l$ U明确提及此次出行结束后会返回原籍国继续生活：来加拿大学习是真实意愿，有房屋需要管理，有家庭成员需要照顾, etc.

五、签证官的考量

* L6 {" ?. U& a5 C5 ?) l在审理临时居民的签证申请时，签证官会考虑以下几点：

「在加拿大停留的时间 The length of time that the client will be spending in Canada」

+ a8 j" S" b* m「与原籍国的联系 Obligations and ties to the home country」
